This Agreement is between Event Resource Center (hereinafter “ERC”), and Service Client (hereinafter “Client”) relating to the Event Resource Center Services.
ERC requires a 50% retainer upon remittance.
Client agrees to pay the remaining fee plus any applicable sales taxes and extra hours, the event day. Failure of Client to pay will result in a breach of this Agreement and a $75 late fee will be added to the invoice.
50% Retainer Exception: ERC allows School and non- profit organizations to pay the invoice in full the day of the event once the price is mutually agreed upon by both parties. School and non-profit organizations are not exempt from ERC cancellation policy.
LIMITATION OF LIABILITY:
While every reasonable effort will be made to produce and deliver an outstanding service, ERC entire liability to Client for any breach of this Agreement, claim, loss or injury arising from ERC performance is limited to a refund to Client of amount paid for its services less the value of the services provided.
If Client cancels these services in writing more than 90 days prior, the full sum of the deposit will be refunded. If cancellation occurs within 90 days of your event, we will still refund your deposit if we are able to secure a new booking for your specifically reserved time. ERC warrants that in the event of a cancellation, a reasonable effort will be made to secure a replacement assignment of at least equal value. If cancellation occurs less than 30 days prior to the event, ERC will not refund any portion of fees paid for Photo Booth Services. If cancellation occurs 72hr before the start of the rental, said renter is responsible for the entire agreed rental price, unless ERC finds a new photo booth renter for the agreed date. School and non-profit organizations are not exempt from ERC cancellation policy and are responsible for 50% of invoice at time of cancellation if eligible or 100% of invoice if eligible.
